Congratulations on your purchase from an Outdoor Living Supply company and thank you for taking advantage of our services.
Standard delivery includes driveway placement of the product. Outdoor Living Supply, nor its authorized delivery agents are responsible for cleanup of mud left in the street due to the materials being delivered.
Delivery services completed by Outdoor Living Supply or its authorized delivery agents do not include on-premises services, placement, or installation of merchandise by the delivery agent.
If conditions are deemed safe by the driver, product may be placed on the property off of the driveway. However, this service requires a Waiver and Release of Liability that will be presented by the driver at the time of delivery. The requirement to sign the Waiver and Release of Liability will require that someone be present for the delivery or complete the form below before the delivery.
Please note that by requesting our delivery agent to place product off driveway, all damage to the property in the form of but not inclusive of irrigation, pipes, ruts, wires, turf areas and non-vehicle rated concrete will be the sole responsibility of the customer.
WAIVER AND RELEASE OF LIABILITY: BY FILLING OUT THE BELOW FORM YOU HAVE AUTHORIZED TO RECEIVE MERCHANDISE OR MATERIALS (“YOU”/ “YOUR”), ARE AGREEING TO RELEASE OLS AND ITS DELIVERY AGENTS FROM ANY LIABILITY ARISING FROM THE PERFORMANCE OR ANY DELIVERY OR OTHER SERVICES BY THE DELIVERY AGENT BEYOND DRIVEWAY DELIVERY.
You fully understand that the requested Additional Delivery Services may result in injury to the merchandise delivered or other property, personal injury to yourself or others. You hereby agree to be solely responsible for any injury to person or property arising from or any way connected to the requested Additional Delivery Services and/ or Unauthorized Installation Services and hereby release and forever discharge OLS, it affiliates, officers, directors, employees, agents and Delivery Agent from all liability, claims, demands, losses, expenses, costs, judgments or damages caused, or alleged to be caused, or in any way connected to, the requested Additional Delivery Services and/ or Unauthorized Installation Services.
By filling out the below form, you acknowledge that You have read and fully understand the terms of this waiver and release, understand that You have given up substantial rights by signing it freely and without any compulsion and that You intend it to be a complete and unconditional release of all liability in regard to the requested Additional Services and/ or Unauthorized Installation Services. The above is acknowledged and agreed by:
